The purpose of the Ferqui Body Complaints Channel is to protect whistleblowers from possible serious or very serious administrative offences or infractions of which they have been aware in the workplace, as well as to improve the transparency and ethics that should govern the behaviour of people and companies in society.
The Whistleblowing Channel is the confidential mechanism made available to the company’s employees included in the subjective scope described in article 3 of Law 2/2023, of February 20, 2023, regulating the protection of people who report regulatory and anti-corruption breaches, specifically on possible crimes or infractions established in article 2 of the aforementioned law
The company has implemented an Internal Information System, identifying a person responsible for it, and has drafted an Internal Policy of the System, based on the principles of confidentiality and anonymity, transparency and accessibility, respect for the presumption of innocence, confidentiality, protection of the whistleblower and continuous improvement.
To this end, the company has set up a Whistleblowing Channel consisting of the following email address:
A complaint may also be filed verbally, by telephone call requesting to speak to the person in charge of the System on the 985740420 telephone, or it may also be requested to be made in person before the person in charge of the system. If they wish to remain anonymous, the complainant who sends their complaint via email will do so from an address that does not identify them, avoiding the appearance of names, surnames or alphanumeric data that allow their identity to be deduced.
The email will be answered within a maximum period of 7 days requesting information on the fundamental aspects of the complaint.
Once the necessary data has been collected, the complaint will be investigated within the internal information system, guaranteeing confidentiality, anonymity where appropriate, protection of personal data, and respect for the presumption of innocence. The absence of retaliation against the whistleblower is also guaranteed, for which they must be filed in good faith and with indications of veracity. The investigation may last 3 months or even up to six months in the most difficult cases.
Likewise, you have the right to resort to other external channels of information that may be enabled for this purpose by the different public bodies and, where appropriate, before the institutions, bodies or agencies of the European Union.

Recipients of the data | The recipients are the persons identified in the company’s Information System as responsible for the implementation of the System and its collaborators, as well as those identified in article 32 of Law 2/2023. Only the minimum, essential data and the people necessary to carry out the investigation will be communicated. |
Rights of the Data Subject | Interested parties may exercise their rights of access, rectification, opposition, deletion, limitation of processing, portability or any other data protection rights recognized by the regulations. You may exercise these rights by sending a communication to the Data Protection Officer at proteccióndatos@ferqui.com. You may also lodge a complaint with the Supervisory Authority at any time. In any case, we inform you that, if you prefer, you also have the right to submit your communication, alternatively, to the competent authorities through the existing external channels. |
Duration of treatment | Personal data will be kept in the channel only for the time necessary to decide on the appropriateness of initiating an investigation into the facts reported. In any case, they will be removed from the complaints system after three months if no investigation proceedings have been initiated. If the communication is admitted, the data may continue to be processed by the team responsible for the investigation. Once the investigation is concluded, we will keep them for the time necessary to adopt and execute the corresponding measures and, after that, they will be blocked, for the statute of limitations of criminal, civil, commercial, labor and/or administrative responsibilities. Under no circumstances will the data be kept for a period longer than 10 years. |
